BRUSSELS: In a historic move, the European Union has placed ChatGPT under its strictest digital surveillance, marking the first time an artificial intelligence chatbot has been subjected to the bloc's formidable legal might. This decision, announced on Monday, places the American-made AI under the same scrutiny as the mightiest tech giants, a testament to the growing power of this digital creation.
The EU also designated the Reddit forum and the gaming network Roblox as 'very large' online platforms, a label that carries heavy obligations and oversight. EU technology chief Henna Virkkunen declared, 'ChatGPT, Reddit and Roblox will now be held to a higher standard of scrutiny and accountability in the European Union, in line with their large impact on our citizens and society.'
What Does the EU's 'Very Large' Label Mean for ChatGPT?
This designation applies to platforms with over 45 million monthly users in the 27-nation bloc. ChatGPT, Reddit, and Roblox have all crossed this threshold. Under the Digital Services Act (DSA), these platforms now have four months to comply with stringent rules, including 'assessing and mitigating' risks related to illegal content, harm to minors, mental well-being, fundamental rights, and public security. In a curious twist, the EU has classified ChatGPT as a search engine to bring it under the DSA's umbrella.
ChatGPT's European Footprint: A Giant Among Men
OpenAI's flagship chatbot reported over 159 million users in the EU at the end of March, representing more than a third of the bloc's population. This staggering number underscores the immense influence of this technology. ChatGPT has stated it is 'preparing to meet the additional compliance requirements,' while Roblox expressed pride in being the first gaming platform to receive the label. Joost Hagesteijn, Roblox's general manager for Europe, said, 'Safety is foundational to everything we do and we look forward to continuing our constructive engagement with the European Commission.'
EU's Regulatory Crusade Against Big Tech
The EU is escalating its enforcement against the world's largest digital platforms, despite strong pushback from the United States. The bloc's flagship AI Act, which entered into force in 2024, is already setting global standards. Lena-Maria Boswald of the German think tank Interface noted that ChatGPT's designation sets a 'precedent' and will 'influence the regulatory expectations for every large generative AI system used in the EU.'
What Are the Penalties for Non-Compliance?
Around 30 services, including Google, Apple, Microsoft, TikTok, X, Amazon, and Shein, are already under extra scrutiny. The EU's heavy fines loom large for any platform that fails to comply. This move signals that no digital entity, however powerful, is beyond the reach of law.
