IHC Reserves Verdict on Imran Khan and Bushra Bibi’s Alleged Solitary Confinement

In a case that has gripped the nation, the Islamabad High Court (IHC) on Thursday reserved its judgment on petitions challenging the alleged solitary confinement of former Prime Minister Imran Khan and his spouse, Bushra Bibi. The court, after hearing detailed arguments, will now examine the record before delivering its final order.

Justice Khadim Hussain Soomro presided over the hearing, directing both sides to submit any judicial precedents they wish to rely on in writing. The case has become a flashpoint in the ongoing struggle for justice and human dignity, with the nation’s eyes fixed on the fate of its beloved leader.

What Did the Jail Authorities Claim?

Adiala Jail Superintendent Sajid Baig and Islamabad Advocate General Naveed Hayat Malik argued that the petitions were not maintainable. They maintained that Imran Khan and Bushra Bibi were not in solitary confinement but were instead provided facilities exceeding those of B-class prisoners. The advocate general stated that due to security concerns arising from Imran Khan’s political profile, he was housed separately, but this could not be termed solitary confinement.

The jail authorities claimed that Imran Khan had access to over 500 books, daily newspapers, and a compound of seven cells where he could move freely during the day. They argued that true solitary confinement would require continuous lockup in a single cell, which was not the case here.

Barrister Salman Safdar, counsel for the petitioners, disputed the government’s stance, arguing that Imran Khan and Bushra Bibi were subjected to prolonged isolation amounting to mental torture. He cited his meeting with Imran Khan earlier this year, where the former prime minister complained of deteriorating eyesight, restricted access to lawyers and family, and an inadequate supply of books.

Despite facing over 300 criminal cases, Imran Khan has been denied regular consultations with his legal team. A 65-minute meeting arranged in April, after the IHC chief justice’s intervention, was the first meaningful consultation in months, during which most of the discussion centered on the mental distress caused by prison conditions.

Justice Soomro questioned the advocate general on whether Imran Khan had been given B-class facilities and remarked that it would have been appropriate if the medical board’s report on his eyesight had been placed before the court. In a separate report, the Adiala jail superintendent denied that Bushra Bibi was in solitary confinement or subjected to discriminatory treatment. She has access to a spacious room, a separate courtyard and kitchen, can move freely during the day, receives regular medical exams by female staff, and is allowed to meet Imran Khan every Tuesday under prison rules.

Aleema Khan, Imran Khan’s sister, addressed the court, alleging that her brother had received only three books since December and had met family members only a handful of times, mostly pursuant to court orders. She urged the court to direct the prison authorities to produce a complete record of meetings.
